WWW.FOXNEWS.COMHunter Biden special counsel got one resume from DOJ to help prosecute presidents sonFIRST ON FOX: Former special counsel David Weiss got little support from the Department of Justice (DOJ) when he sought lawyers to help prosecute President Joe Bidens son Hunter, Weiss told Congress during a recent closed-door interview.Amid delicate plea deal negotiations between Hunter Biden and Weiss in 2023, Weiss said he asked the DOJ deputy attorney generals office for a team of trial lawyers and received a single resume, according to a transcript of the interview reviewed by Fox News Digital."Actually, as I think about the sequencing, I had started to reach out myself directly to offices or people that I knew and make my own inquiries," Weiss told House Judiciary Committee staff of his struggle to hire lawyers for the sensitive job of trying the president's son.Weiss appeared on Capitol Hill for the interview in June as part of the committees inquiry into the DOJs years-long investigation and prosecution of Hunter Biden.SPECIAL COUNSEL WEISS BLASTS BIDEN IN FINAL HUNTER PROSECUTION REPORTNow no longer a DOJ employee, Weiss spoke candidly for hours with the committee, shedding new light on his interactions with the Biden DOJ and giving fresh insight into why Hunter Biden was never charged with certain violations.Weiss was appointed U.S. attorney of Delaware during the first Trump administration and began investigating Hunter Biden at that time. Former Attorney General Merrick Garland made Weiss special counsel in August 2023 after a plea agreement with Hunter Biden fell apart.Republicans had accused Weiss of offering Hunter Biden a "sweetheart" plea deal that involved only misdemeanors. But in an unusual move, a judge rejected the deal, leading Weiss to instead bring two successful indictments against the then-first son, one for illegal gun possession and another for nine tax charges, including three felonies.Weiss came under enormous scrutiny by Republicans and Democrats for his handling of the investigation, which had become a hyper-political national news story centered on the salacious behavior and wrongdoings of Hunter Biden, a recovering drug and alcohol addict, and allegations that Joe Biden was complicit in his sons crimes.Republicans claimed Weiss was not tough enough on Hunter Biden, while Democrats said he was being treated more harshly than a typical defendant because he was the presidents son. Joe Biden ultimately granted an unconditional pardon to his son, a move widely criticized by members of both parties.Weiss said during the interview that he was "fortunate enough to obtain a couple very excellent prosecutors," a reference to the two DOJ attorneys who handled trial preparations for Hunter Biden.But, Weiss also indicated that when he first requested lawyers in the spring of 2023, he had to be self-sufficient in finding them and that the deputy attorney general's office was unhelpful. Weiss noted he did not deal directly with former Deputy Attorney General Lisa Monaco at all and assumed she was recused from Hunter Biden's cases.Weiss said that at one point he ran into the director of the Executive Office for United States Attorneys, which handles recruitment, at an event and asked if any hiring progress had been made.Weiss did not "have a whole lot of success" during that conversation, he said."What do you mean, you didnt have success? They didnt give you lawyers?" a committee aide asked."I got one resume," Weiss replied.The aide asked, "Nobody wanted to come prosecute Hunter Biden?""I dont want to say that because I dont know that they werent trying to find people," Weiss said. "All I know was I didnt get a whole lot of resumes."HUNTER BIDEN: A LOOK AT HOW THE SAGA SPANNING OVER SIX YEARS UNFOLDEDWeiss eventually gained two attorneys, Leo Wise and Derek Hines, who went on to secure a conviction by a jury in Delaware after a week-long trial on gun possession charges and a guilty plea to all nine of Hunter Biden's tax charges.A committee aide pressed Weiss on why he felt there was "such a drought" of help at DOJ headquarters."As I said a moment ago I did not receive a lot of resumes in response to my initial request," Weiss said, noting that eventually the DOJ's Public Integrity Section assisted him.Asked if the Public Integrity Section helped him because Weiss proactively reached out, Weiss replied, "Probably."For his testimony, the Trump DOJ gave Weiss permission in a letter to talk to Congress about Hunter Bidens cases. The department noted, however, that it could not authorize Weiss to talk about the former first sons confidential tax information.Weiss suggested, though, that he would have charged Hunter Biden for the 2014 and 2015 tax years if he could have.FLASHBACK: DEMOCRATS CLASH WITH REPUBLICANS OVER PROSPECT OF CALLING HUNTER BIDEN IN IMPEACHMENT TRIAL"To the extent I can put together and this is general a case that involves more years than not and allows me to more fully develop allegations about a course of conduct and a scheme, that's better for the prosecution," Weiss said. "So it's not like I'm looking to cut out years generally when you're pursuing a tax investigation."During the years in question, Hunter Biden was raking in $1 million per year as a board member of the Ukrainian energy company Burisma while his father, then vice president, was overseeing foreign policy with Ukraine. The scenario became ripe for questions about conflicts of interest, in part because of suspicious interactions between Hunter Biden and the Obama State Department.In Weisss final special counsel report, he dodged explaining why he brought charges of failure to pay taxes and tax evasion against Hunter Biden only for the tax years after 2015, citing Joe Bidens pardon. Now, Weiss said, he would be more willing to talk about it if he were legally allowed to do so.Chairman Jim Jordan, R-Ohio, pressed Weiss, saying the "political aspects of Burisma" raised "glaring" questions about the prosecutorial decisions made for the years for which Hunter Biden avoided charges."I understand," Weiss replied. "Absolutely. Yes. And I wish that I could address it. "On the one hand, we have an increasingly radicalized socialist movement, out of step with mainstream voters, dependent on the pander politics of the welfare state, addicted to a sectarian Neo-racialist identititarian ideology, and aligning with the world's most oppressive movements in the Mideast. And most of this is driven by a delusional worldview that progressives are somehow the liberating oppression in West. And we have done that."The party's identity crisis has been underscored by claims it has gone too far to the left in recent years, most notably on social issues such as transgender issues, with even the New York Times editorial board chastising the party in a March op-ed."Democrats should recognize that the party moved too far left on social issues after Barack Obama left office in 2017. WWW.FOXNEWS.COMSecond suspect arrested in CBP officer shooting has lengthy criminal past, DHS saysThe second illegal immigrant suspect arrested Monday in the shooting of an off-duty U.S. Customs and Border Protection Officer in New York City over the weekend has a lengthy criminal background, officials said.Cristian Aybar Berroa of the Dominican Republic "illegally entered the United States on June 19, 2022, and was released into the country on interim parole pending his immigration hearing," according to theDepartment of Homeland Security.He then allegedly committed a litany of crimes in New York City, including arrests for 2nd degree reckless endangerment in May 2023 and 4th degree felony grand larceny and petit larceny in March and April 2024, officials said.Following the April 2024 arrest, "Despite an active ICE detainer, the New York City Department of Corrections released Berroa back onto NYC streets," Homeland Security said.NOEM BLAMES SANCTUARY POLICIES FOR MIGRANT ACCUSED OF SHOOTING OFF-DUTY CBP OFFICERBerroa was then arrested by the New York City Police Department in February 2025for 2nd degree reckless endangerment, reckless driving and for driving without a license, the DHS continued. "On June 12, 2025, Berroa pled guilty to petit larceny at the Bronx County Supreme Court. This plea was made in consolidation of all his previous arrests, and he was conditionally discharged and allowed to roam the streets of NYC," it also said. "A judge ordered Berroa a final order of removal on January 3, 2023."He and Miguel Francisco Mora Nunez are now expected to face federal charges in connection to the shooting at New York Citys Fort Washington Park late Saturday, Interim U.S. Attorney for the Southern District of New York Jay Clayton announced Monday.SHOOTER WHO OPENED FIRE ON BORDER PATROL AGENTS IN SOUTH TEXAS IDENTIFIED BY POLICE CHIEFOfficials believe the shooting happened during an attempted robbery."A witness of the attack stated that she and the victim were sitting on the rocks by the water when two subjects on a scooter drove up to them, dismounted the scooter and approached them with a firearm drawn. The off-duty CBP officer responded by withdrawing his own firearm in self defense. The CBP officer was shot in his right arm and left cheek. Thankfully, the officer is in stable condition at the hospital," Homeland Security said.NYPD Commissioner Jessica Tisch said Monday that Berroa was the scooter driver in the incident."He was arrested eight times between March and April 2024 for grand larcenies and robberies involving a scooter in the Bronx," she said. "He's also a suspect in at least four additional cases. He entered this country illegally through Texas in 2022."Multiple sources within U.S. Immigration and Customs Enforcement told Fox News that the men involved in the shooting are believed to be the same men caught on video in an armed robbery of a business in Leominster, Massachusetts, in February. Pellegrino said he had his head down for just a moment when the men suddenly charged at him, stabbing him in the neck during the struggle and taking his luggage.PASTOR SOUNDS ALARM ON 'GODLESS GENERATION' AFTER FIGHTING BACK AGAINST TEEN CARJACKER"He (the attacker) then ripped off the gold crucifix from my neck, and ran away with my luggage as the train doors opened," he explained to the outlet.Bleeding heavily, Pellegrino managed to reach the next platform and yelled out for help."I was left on the platform screaming for my life," he recalled.A photo posted on a GoFundMe page created to support his recovery shows him bloodied and receiving care from paramedics.KNIFE-WIELDING ILLEGAL MIGRANT ACCUSED OF THREATENING US ATTORNEY ON ALBANY, NY STREETSAccording to the fundraiser, Pellegrino was robbed and sustained a serious neck wound. The attackers, identified as North African migrants, allegedly took his luggage, passport, laptop and a gold cross he was wearing.Pellegrino is currently recovering in an Italian hospital and remains in good spirits, according to his friend Finn McCole, who started the GoFundMe campaign."Nick is grateful to be alive and is relying on his faith," McCole said. "Even though he wouldn't ask for help himself, we're raising funds to cover his medical bills and replace his stolen belongings."SUSPECT ARRESTED IN HORRIFIC NYC RUSH-HOUR SUBWAY STABBING THAT INJURED 2TheSan Francisco Chroniclereported that four suspects from Morocco and Tunisia were arrested several hours later at another train station about an hour from the crime scene. Authorities believe these same individuals may also be connected to a separate assault on a taxi driver and possibly another attempted robbery on a train.After several days in the hospital, Pellegrino was released. The conviction came just five years after Hernandez confessed to police that he lured the boy into the basement of the convenience store he worked at, using soda.Prosecutors said Hernandez choked Etan, stuffed his body into a plastic garbage bag hidden inside a box, and took it out with the trash.Hernandez was sentenced to 25 years to life behind bars in April 2017.MENENDEZ BROTHERS BANK ON NEW TRIAL AS BACKUP IF PAROLE BID FAILSBut on Monday, a federal appeals court overturned the conviction because of how the trial judge handled a note from the jury during Hernandezs second trial, which took place in 2017 the first trial took place in 2015 and ended in a jury deadlock.The appeals court found that the trial judge in 2017 gave "clearly wrong" and "manifestly prejudicial" instructions to the jury in response to a question about the suspects confessions to police.During jury deliberations, the jury asked the judge whether, if it deemed invalid a confession Hernandez made before being advised of his Miranda rights to remain silent, it must also disregard a subsequent confession after those warnings were given.The judge told the jury no, but the appeals court said that answer was incorrect.MENENDEZ BROTHERS SCORE CRUCIAL LEGAL VICTORY IN DECADES-LONG FIGHT AS THEY AWAIT POTENTIAL FREEDOMThe decision overturns the guilty conviction, and the court ordered Hernandez to be released unless the state gives him a new trial within a reasonable period to be set by the lower court judge.The Manhattan District Attorneys office said it was reviewing the appeals courts decision.Hernandez, of Maple Shade, New Jersey, confessed soon after his brother-in-law told detectives the store clerk may have been a suspect, The New York Times reported. The relative claimed Hernandez told a prayer group decades earlier that he'd killed a child in New York.EXPERT WARNS IDAHO MURDERER'S PLEA DEAL STRATEGY IS A DANGEROUS CALCULATED 'LONG GAME'However, the defense claimed he was mentally unstable, and incapable of keeping the truth separate from fiction. "Pedro Hernandez is an odd, limited and vulnerable man," defense attorney Harvey Fishbein said during closing arguments.Defense lawyers also pointed to a different man who was long the prime suspect a convicted Pennsylvania child molester who made incriminating remarks about Etan's case in the 1990s and who had dated a woman acquainted with the Patz family. He was never charged and denied killing the boy.The sentencing was the culmination of a long quest to hold someone criminally accountable in a case that affected police practices, parenting and the nation's consciousness of missing children.Since the boy's disappearance, law enforcement and volunteers have beefed up their capabilities in finding missing or lost children, establishing a nationwide network of search teams.
