Luigi Mangione moves to dismiss death penalty, federal case citing Bondi comments
Lawyers for Luigi Mangione are again asking a federal judge in New York to block the Justice Department's attempt to seek the death penalty if he is convicted in the assassination of UnitedHealthcare CEO Brian Thompson, arguing that the government is pursuing capital punishment for political purposes and that top officials have inappropriately discussed the proceedings outside of court.Mangione, a 27-year-old former Ivy Leaguer from a wealthy Maryland family, allegedly stalked Thompson to New York City, then shot him in the back on a sidewalk just steps from a hotel where the victim was supposed to meet Wall Street investors for a shareholder conference later that morning. After a photo of the grinning suspect went viral, police found him in Altoona, Pennsylvania, where he was arrested five days after the Dec. 4 ambush.MANGIONE SUPPORTERS PUSH 'JURY NULLIFICATION' AS UNITEDHEALTHCARE CEO ASSASSINATION TRIAL LOOMSIn a 118-page motion filed Saturday, Mangione's lawyers accused the Trump administration of using his case to launch the president's renewed push to expand the use of capital punishment and "to demonstrate its loathing of the prior administration" after former President Joe Biden removed 37 out of 40 inmates from the federal death row before leaving office."Luigi Mangione is a 27-year-old Italian-American dual citizen whose beautiful, promising life has been derailed," six attorneys for Mangione claimed in the motion. "Born in Maryland into a large, close, loving family, he is now fighting for his life against a government that seeks to execute him."They also took issue with how Attorney General Pam Bondi has discussed the case and the Justice Department's push for capital punishment online and in the media. In particular, they singled out a comment she made on "Fox News Sunday" in April: "I was a capital prosecutor. I tried death penalty cases throughout my career. If there was ever a death case, this is one.""This statement alone is enough to prejudice the entirety of this case," Mangione's lawyers wrote. "The Attorney General of the United States is telling the public that based on her personal experience as a capital prosecutor who tried death penalty cases throughout her career that Mangione is guilty and should be executed."LUIGI MANGIONE DEFENSE SHARED SAME RECORDS THEY CLAIMED CONSTITUTED PRIVACY VIOLATION: PROSECUTORSAccording to his lawyers, the Justice Department and law enforcement leaders have "serially violated his constitutional rights." They claim he was "overcharged" with a death penalty-eligible offense and noted that a New York judge recently threw out state-level terror charges brought by Manhattan District Attorney Alvin Bragg. He now faces a top state charge of second-degree murder. Federally, he is accused of stalking, murder through use of a firearm and other gun charges. They identified "six ways" they say his constitutional rights have been violated:LUIGI MANGIONES LAWYERS SLAM VAGUE ALLEGATIONS, DEMAND FEDS SHOW THEIR HAND IN BAREBONES CEO MURDER CASEAdditionally, the defense accused New York City leaders of overhyping and overcharging the state case, leaking details about a "manifesto," a term they don't want used, and anti-health insurance industry messages written on bullet casings connected to the murder. The defense is asking for the court to dismiss the federal indictment outright, block the government from seeking the death penalty or strike the Justice Department's notice of intent to seek the death penalty.Federal prosecutors previously shot back that the defense has no authority over how prosecutors present evidence to a grand jury.Thompson, 50, was a Minnesota father of two visiting New York City for a publicly announced shareholder conference.Mangione faces charges in New York, Pennsylvania and federal court in connection with the slaying and the suspected murder weapon, which had 3D-printed parts. He has pleaded not guilty.

Macron stakes anti-Trump global role with Gaza initiative at UN summit
As world leaders gather in New York for the United Nations General Assembly, French President Emmanuel Macron is seizing on the Israeli-Palestinian conflict to stake out global leadership and, critics argue, to position himself as a counterweight to President Donald Trump.Renewing his call for recognition of a Palestinian state, Macron has also put forward a proposal for a multinational force to take over from the Israel Defense Forces (IDF) "the day after" the Gaza war, according to TheTimes of Israel. For Macron, the United Nations General Assembly is a stage to project France as an alternative power. "Macrons policy on the Israel-Palestine conflict reflects his broader ambitions on Frances foreign policy, that is, the idea that the country, as a middle European power, can offer an alternative to the U.S.-China competition," Jean-Loup Samaan, a senior research fellow at the National University of Singapores Middle East Institute, told Fox News Digital. "In this specific case, Macron believes that his push for a Palestinian state will increase French credibility in the Arab world and the so-called Global South."MACRON STRUTS ON WORLD STAGE AS REVOLT OVER FRANCES SOARING DEBT PUTS HIS PM ON THE BRINK"We have to recognize the legitimate right of Palestinian people to have a state," Macron said in an interview broadcast Thursday on Israels Channel 12. "If you dont give a political perspective, in fact, you just put them in the hands of those who are just proposing a security approach, an aggressive approach." He went further, denouncing Israels ground offensive in Gaza City as "absolutely unacceptable" and "a huge mistake."The comments infuriated both Israel and the United States, which argue that recognition emboldens extremists and rewards Hamas, the group responsible for the Oct. 7, 2023 massacre.Macron, however, insists recognition is the only way forward, reviving the long-stalled two-state solution. More than 145 countries already recognize Palestine, and European allies, including the U.K., Canada, Australia, Portugal, Malta, Belgium, and Luxembourg, are expected to follow Frances lead in the coming days.Yet analysts warn Macrons track record suggests otherwise. "If you want to know how UN-sponsored peacekeepers do with terrorist groups in the region, we have a 20-year case study in UNIFIL, which enabled rather than denied Hezbollah the ability to grow into a massive military threat," Richard Goldberg, senior adviser at the Foundation for Defense of Democracies, told Fox News Digital."Macron is certainly driven by his beleaguered domestic political situation and the large French Muslim population, but in his own mind he's also been down this road in Lebanon, where France has historic equities. The record is pretty clear: Macron has never delivered on anything; security improvements have only come through U.S. pressure and Israeli military might," Goldberg said.Just days before Macrons push, Trump met with former British Prime Minister Tony Blair and Jared Kushner to discuss Gazas future and is set to hold a meeting tomorrow with Arab leaders on "the day after," sources confirm to Fox News Digital. The overlap has fueled speculation that Macron is maneuvering to outshine Trump and claim the mantle of statesman-in-chief.TRUMP WHISPERS CRAZY PUTIN DEAL THEORY TO MACRON IN HOT MIC MOMENTGoldberg added bluntly: "He may perceive himself that way, but I dont think many in Washington spend a lot of time thinking about him."Anne Bayefsky, director of the Touro Institute on Human Rights and the Holocaust, called Macrons maneuvering "a blatant power-grab." She told Fox News Digital: "The fact is that would-be Emperor Macron has no clothes. The promise he is waving around of Palestinian leader Mahmoud Abbas promise to soon hold elections and abandon dictatorship and terror screams scam.""At home, foreign policy topics are not driving the current political troubles, which are primarily focused on Frances need to reduce its fiscal deficit," Samaan noted. "I think Macrons initiative on Palestine has more to do with his personal aspirations in terms of legacy. Hell leave office in 2027."The proposed Gaza force, modeled on UNIFIL in Lebanon where France has long played a role, would demand French resources and likely face opposition in parliament from both the far left and far right, and without U.S. endorsement, Israeli buy-in, or domestic consensus in France, the initiative could stall before it begins.

Erika Kirk's forgiveness of husband's alleged killer sparks widespread admiration
Erika Kirk, the widow of Charlie Kirk, triggered a wave of positive responses from both sides of the political aisle when she forgave her husbands alleged killer on Sunday.Tyler Robinson, the 22-year-old suspect charged in Charlie Kirk's murder, was much like the other young men that her husband encountered, Erika Kirk said at the memorial service.Charlie Kirk "wanted to save young men, just like the one who took his life," she told the massive crowd at State Farm Stadium in Glendale, Arizona."Our Savior said, 'Father, forgive them, for they know not what they do.' That young man I forgive him," Erika Kirk said, drawing a standing ovation. "I forgive him because it was what Christ did, and it's what Charlie would do."LEADERS AND INFLUENCERS FLOOD SOCIAL MEDIA WITH TRIBUTES TO CHARLIE KIRK AS THOUSANDS PACK ARIZONA MEMORIALMany public figures and commentators praised her words on social media and other media platforms."Obviously, there are some people, there are some on the hard right that are trying to use this unspeakable tragedy to actually stifle speech, that conversation, the resurgence in cancel culture," said MSNBC's Joe Scarborough on Monday morning, the day after the memorial."But right now, just talking about the memorial service yesterday, no doubt so many people deeply moved across the country by Erika Kirk forgiving, for doing what Jesus Christ asked his followers to do. To pray for your enemies, to love your enemies, to pray for those who persecute you. And so much of the service from the people who knew Charlie, loved him, worshipped with him, grew up with him, family members of him, his pastor. It was a message of love and mercy and forgiveness," Scarborough said."I think what honestly Ill take away from tonight is watching the weight of a woman, a mother, lose her husband," NBC White House CorrespondentVaughn Hillyard said on MSNBC moments after Kirk spoke.ERIKA KIRK SAYS LATE HUSBANDS DEATH SPARKED REVIVAL AT ARIZONA MEMORIAL"It was just remarkable," co-host Elise Jordan said, agreeing with Hillyard during an MSNBC panel that followed the memorial.Ex-MSNBC host Mehdi Hasan called the speech "powerful.""I dont think I could forgive someone who murdered my spouse so Im not going to pretend this was anything other than a powerful, very moving, very Christian statement from Charlie Kirks widow Erika," Hasan, who now runs Zeteo, wrote."Forgiveness is beautiful," former presidential candidate Andrew Yang posted on X.The Washington Post's editorial board highlighted a contrast between Erika Kirk and President Donald Trump's speech, claiming the commander-in-chief leaned too heavily on political sentiments."The heartfelt grieving highlighted the tension between Trumps brand of hardball politics and the spirit of Christian charity that Charlie Kirk imperfectly espoused. The young activist helped change the trajectory of American political history," the board wrote Sunday night."Trumps speech wasnt worthy of those efforts. But at least the event showed the possibility of a different direction under the presidents most likely successors."CNN commentator Xochitl Hinojosa, who previously served as communications director for the Democratic National Committee, said she "came to the moment. She understood that people need to be brought together."Public figures on the right also lauded Erika Kirk's message of forgiveness.CHARLIE KIRK URGED YOUTH TO REJECT 'SEXUAL ANARCHY' AND HOOKUP CULTURE, PASTOR RECALLS"Erika Kirk's remarks... I have no words. This is exactly what America needed to hear. Filled with love, strength, compassion, honesty, and forgiveness. This is the most powerful speech I've ever heard," OutKick "Gaines for Girls" host Riley Gaines said."Todays cover of the @nypost. When the world expected anger, Erika Kirk chose forgiveness," Rep. Nancy Mace, R-S.C., posted on X."I have never witnessed anything more powerful or moving," Kid Rock wrote."Erika Kirk didnt need anyones permission to do the thing only she could do. And she did it with grace," another conservative writer said.

From Kirk to Kimmel: Fiery NJ debate spotlights political violence and free speech
Republican Jack Ciattarelli said it was "wrong" for Democrat Rep. Mikie Sherrill to criticize Charlie Kirk after voting "yes" on a U.S. House resolution condemning his assassination a clash that escalated when Sherrill invoked Jimmy Kimmels suspension over remarks about Kirk during their first debate Sunday.During their first debate of the general election in Lawrenceville, N.J., on Sunday, moderators asked the candidates if they would support legislation designating political violence as a hate crime in the state of New Jersey."My opponent on Friday went down to Washington, voted yes on a resolution to celebrate Charlie Kirk's life, but then within minutes sent out a statement that basically condemned him. I think that was wrong," Jack Ciattarelli said, while affirming his support for the New Jersey bill. When pressed about her disagreement with Kirk, Sherrill said, "I think it's fair to have free speech, but I think it should go to everyone, to Jimmy Kimmel and to myself as well."WATCH: LAWMAKERS WRESTLE WITH HOW TO APPROACH HATEFUL POLITICAL RHETORIC IN WAKE OF KIRK ASSASSINATIONABC on Thursday suspended the "Jimmy Kimmel Live!" host indefinitely following controversial comments he made about Kirk's assassination.58 HOUSE DEMS VOTE AGAINST RESOLUTION HONORING 'LIFE AND LEGACY' OF CHARLIE KIRKQuestions about political violence seeped onto the New Jersey gubernatorial debate stage on Sunday night as mourners gathered more than 2,000 miles away to honor Kirk's life and legacy. After voting "yes" on the resolution condemning Kirk's assassination, Sherrill released a statement criticizing Kirk's character."Charlie Kirk was advocating for a Christian nationalist government and to roll back the rights of women and Black people this flies in the face of every value I hold dear and that I fight for. But the Constitution protects free speech, even for those I vehemently oppose," she said. While ripping his opponent for her comments about Kirk, Ciattarelli also criticized Sherrill for not answering the moderator's question about the state legislation."My direct answer is I voted to protect free speech. I voted to end political violence. I also think it's fair, Jack, to speak up when you disagree with something," Sherrill said."In this nation, we should be able to have free speech," Sherrill said. "I vow to defend and fight for free speech my entire life, but it should never devolve into political violence."Kirk's assassination less than two weeks ago on Utah Valley University's campus reignited a fierce debate about the rise of political violence in the United States.CLICK HERE TO GET THE FOX NEWS APP"I think it is the responsibility of any public official and candidate for office to engage in rhetoric that doesn't divide us," Ciattarelli said Sunday. Trump to reveal medical finding he calls answer to autism in major announcement
President Donald Trump is poised to unveil a "significant" medical and scientific finding for U.S. children Monday and said Sunday he believes there may be an "answer" to autism now.The Trump administration said in April it would kick off a massive research initiative to understand the cause of autism by September."Tomorrow were going to have one of the biggest announcement(s) medically, I think, in the history of our country. I think youre going to find it to be amazing," Trump said Sunday at the memorial service for conservative activist Charlie Kirk. "I think we found an answer to autism."RFK JR ATTRIBUTES RISE IN AUTISM TO ENVIRONMENTAL FACTORS, WHILE CDC POINTS TO IMPROVED DIAGNOSTIC PRACTICESNo additional details were immediately provided, and the White House did not immediately respond to a request for comment from Fox News Digital.White House press secretary Karoline Leavitt said Monday that the announcement was related to the "childhood autism epidemic.""This will be a powerful display of how the entire Trump administration is committed to addressing root causes of chronic conditions and diseases, embracing full transparency in government and championing gold standard science," Leavitt said.Meanwhile, the Trump administration is expected to announce that it will caution pregnant women against using Tylenol during pregnancy except if they have a fever, the Washington Post reports, as the administration studies if use of the drug might be tied to autism.Tylenol maker Kenvue did not immediately respond to a request for comment from Fox News Digital. However, Kenvue recently said in a statement that acetaminophen, the generic name for Tylenol, is the safest pain reliever for pregnant women."Acetaminophen is the safest pain reliever option for pregnant women as needed throughout their entire pregnancy," Kenvue said in a statement Sunday. "Without it, women face dangerous choices: suffer through conditions like fever that are potentially harmful to both mom and baby or use riskier alternatives."MEDICAL GROUP GOES AGAINST CDC, RECOMMENDS COVID SHOTS FOR YOUNG KIDSThe Centers for Disease Control and Prevention (CDC) released a survey in April that found that autism prevalence is on the rise and said the increase "might be due to differences in availability of services for early detection and evaluation and diagnostic practices."Specifically, the survey found that one in 31 8-year-old children were diagnosed with autism in 2022 up from one in 36 in 2000.TRUMP DEMANDS DEFINITIVE ANSWER AMID ONGOING DEBATE OVER COVID-19 VACCINESMeanwhile, Department of Health and Human Services (HHS) Secretary Robert F. Kennedy Jr. has pointed to environmental factors as the root cause of autism."This is coming from an environmental toxin, and somebody made a profit by putting that environmental toxin into our air, our water, our medicines, our food," Kennedy said in April at an event related to the CDCs report. "And it's to their benefit to say Oh, to normalize it, to say all this is all normal, it's always been here. That's not good for our country."

'Burberry Bandit' with dozens of prior arrests walks free after latest blue city crime spree: report
A New York City felon known as the "Burberry Bandit" is back on the streets after being released from jail following a string of alleged bank robberies.Cornell Neilly, 35, earned the nickname after he was caught on surveillance camera in 2012 wearing a similar pattern associated with the luxury brand, according to the New York Post.Neilly was arrested on Sept. 15 after police said he robbed five banks throughout New York City over the course of one month, the outlet reported. In each case, Neilly allegedly passed a note to the bank teller demanding cash, the NYPD confirmed to Fox News Digital.SUSPECTED CINCINNATI BEATING 'COORDINATOR' GRANTED BOND AGAIN AFTER FEDERAL DRUG ARRESTThe accused bank robbers spree allegedly began on Aug. 16, when he strolled into the Chase Bank at 27th Street and Seventh Avenue in Midtown Manhattan and handed the teller a note demanding $3,500, the Post reported. The teller reportedly handed him $1,000 before he made his escape.Neilly allegedly asked for the same amount of money when he entered the Chase Bank on Park Avenue and East 26th Street on Aug. 25, where he ultimately walked out with $716, the outlet said.Just two weeks later, on Sept. 9, Neilly is accused of entering another Chase Bank in Midtown and demanding $4,500 but reportedly ran off when the teller sounded the alarm.VICTIM IN VIRAL CINCINNATI STREET BRAWL NOW CHARGED IN CASE, POLICE SAYOn Sept. 12, Neilly allegedly demanded $3,500 from theChase Bank on West Fourth Street in the West Village. The next day, he allegedly made off empty-handed after handing a teller at the Chelsea Chase Bank a note that read, "This is a robbery. I want all large bills. Now. This is real," causing the employee to trigger the banks silent alarm.Neilly has a long rap sheet of over 34 prior arrests for previous bank robberies, the NYPD confirmed to Fox News Digital. However, upon appearing in front of Brooklyn Supreme Court Judge Jeffrey Gershuny, he was allowed back on the streets on supervised release, according to the Post. The 2019 appointee of then-Mayor Bill de Blasio reportedly rejected the prosecutions request for $50,000 cash bail or $150,000 bond.ALLEGED BITCOIN TORTURER WALKS FREE ON $1M BOND AFTER TWO-MONTH RIKERS ISLAND DETENTION"The fact that the bail was declined by this judge is negligent on the judges part," an NYPD officer who asked to remain anonymous told the New York Post. "It shows a real lack of care for public safety.""At what point does he keep getting out and gets desperate and brings a gun to a robbery instead of a note and kills somebody?"The controversial decision comes just one month after Gershuny was demoted to presiding over misdemeanor cases in criminal court following an incident in which he reportedly pulled out his own gun on the bench while hearing a weapons case, the Post reported.TRUMP DEMANDS END TO CASHLESS BAIL, SAYS 'COMPLETE DISASTER' DRIVING CRIME IN CITIES, ENDANGERING POLICEAccording to the Post, in an August court hearing, Gershuny asked a police officer to demonstrate how a suspect was concealing a weapon, before reaching for his own gun while presiding over the case. The incident reportedly resulted in Gershuny being moved to hearing night court cases in Manhattan Criminal Court."The court system does not comment on individual bail determinations, whether in Criminal Court or in Superior Court," Al Baker, spokesman for the state Office of Court Administration, said in a statement to Fox News Digital."It is important to note, however, that the vast majority of bail decisions turn on the courts discretionary weighing of a broad range of factors in order to make an individualized assessment of the defendants risk of flight to avoid prosecution. That assessment involves due consideration of information and arguments presented by the prosecutor and defense counsel, as well as other materials submitted to the court."Neilly is charged with five counts of felony robbery and is scheduled to return to court on Oct. 1, according to court documents obtained by Fox News Digital.Neilly's attorney did not immediately respond to Fox News Digital's request for comment.

Thune slams Democrats' 'cold-blooded partisan' tactics as funding deadline nears
Senate Majority Leader John Thune, R-S.D., wants to jam Senate Democrats with the GOPs short-term funding extension, but so far they arent ready to play ball.Republicans and Democrats in the upper chamber blocked dueling continuing resolutions (CRs) from both parties last week and have now left Washington, D.C., until Sept. 29, effectively giving lawmakers in the upper chamber only two working days before the midnight deadline on Sept. 30.Both sides are at an impasse. Senate Republicans argue that the "clean" extension, which would last until Nov. 21 and lacks any partisan policy riders, is everything Democrats dreamed of when they controlled the upper chamber.TRUMP-APPROVED PLAN TO AVERT GOVERNMENT SHUTDOWN SCUTTLED BY SENATESenate Democrats led by Senate Minority Leader Chuck Schumer, D-N.Y., however, argue that they want a seat at the negotiating table and are adamant that expiring Obamacare premium subsidies must be dealt with now, rather than at the end of the year."They're trying to use what they think is leverage to get a bunch of stuff done," Thune said. "It's never going to happen. I mean, can you imagine anything in that bill that they sent that we voted down today, passing in the Republican House of Representatives? Absolutely not. It's just not serious."Democrats proposal included a permanent extension to the expiring Obamacare subsidies, clawbacks of canceled funding for NPR and PBS, and it would have repealed the healthcare provisions in President Donald Trump's "big, beautiful bill" policy that would reverse the nearly $1 trillion in Medicaid cuts while also getting rid of the $50 billion rural hospital fund."They're not being serious," Thune said. "This is just a cold-blooded partisan political attempt to try and score political points with a left-wing base."Though he has not taken the option off the table, its unlikely that Thune would cut this recess short. Instead, he wants to use the impending deadline to back Senate Democrats into a corner. House Speaker Mike Johnson, R-La., played into that strategy, too, when he announced that the House would not return until after the funding deadline.Thune is ready to bring the same CR passed by House Republicans last week to the floor.SENATE REPUBLICANS BLOCK DEMOCRATS' 'FILTHY' COUNTEROFFER AS SHUTDOWN DEADLINE LOOMSSen. Chris Murphy, D-Conn., railed against the likelihood that lawmakers wouldnt return to Capitol Hill until the deadline was directly on them."The Republicans want to shut down," he said. "A) they refuse to negotiate, and B) they're sending us home for the week before the government shuts down. So you know this, this seems like a planned shutdown. As far as I can tell, there's zero effort, zero effort by Republicans to try to solve this problem."Schumer and Democrats have pinned the blame on Trump and argue that his insistence that Thune only needs Republican votes was a sign that Democrats should be cut out of the process. Thune will need Democratic votes to advance through the 60-vote filibuster threshold in the Senate. The top Senate Democrat hoped Thune and Republicans would "now see that the only way to avoid a shutdown is negotiate with Democrats.""We're saying clearly, let's sit down. Let's figure this out," Schumer said. "But Republicans have now left town with no sign they want to avoid a shutdown in a week. They left town. Donald Trump is the shutdown president and Senate Republicans are following him over the cliff."THUNE PANS DEMOCRATS' SHUTDOWN STANCE AS 'BORDERLINE PATHOLOGICAL,' 'LIKE A DISEASE'Schumer and House Minority Leader Hakeem Jeffries, D-N.Y., also sent a letter on Saturday to Trump demanding a meeting, where the pair charged that "Republicans would bear the responsibility" of a partial shutdown."As a result, it is now your obligation to meet with us directly to reach an agreement to keep the government open and address the Republican healthcare crisis," they wrote.Trump said on Saturday that he would "love to meet with them, but I dont think its going to have any impact."A day before, he didnt appear optimistic that a shutdown could be averted."I think we could very well end up with a closed country for a period of time," Trump said.Thune may have defections within his own ranks to contend with, too. Sens. Rand Paul, R-Ky., and Lisa Murkowski, R-Alaska, voted against the GOPs bill. Only Sen. John Fetterman, D-Pa., crossed the aisle to support it.Pauls vote against the bill wasnt a surprise. However, Murkowski, who is an appropriator, contended that she wanted a better bill on the floor than the one presented by Republicans and charged that the back-to-back failures of both bills was a "messaging exercise.""I want to project a message of something that can actually get us through this impasse," she said. "And so my message is a short-term CR that also addresses three past appropriations bills that we've already done. We should include those. We should include a short-term fix of the premium tax credits."
