    JONATHAN TURLEY: Justice Jackson plays pundit to dismay of SCOTUS colleagues
    I wrote recently about the chilling jurisprudence of Justice Ketanji Brown Jackson, who has drawn the ire of colleagues in opinions for her rhetoric and extreme positions. Many have expressed alarm over her adherence to what has been described by one as an "imperial judiciary" model of jurisprudence. Now, it appears that Jackson's increasingly controversial opinions are serving a certain cathartic purpose for the far-left Biden appointee."I just feel that I have a wonderful opportunity to tell people in my opinions how I feel about the issues, and that's what I try to do," Jackson told ABC News.Her colleagues have not entirely welcomed that sense of license. The histrionic and hyperbolic rhetoric has increased in Jackson's opinions, which at times portray her colleagues as abandoning not just the Constitution but democracy itself.WHY JUSTICE JACKSON IS A FISH OUT OF WATER ON THE SUPREME COURTHer dissent in the recent ruling on universal injunctions drew the rebuke of Justice Amy Coney Barrett over what was described as "a vision of the judicial role that would make even the most ardent defender of judicial supremacy blush.""We will not dwell on Justice Jacksons argument, which is at odds with more than two centuries worth of precedent, not to mention the Constitution itself," Barrett wrote. Across the country, liberal judges have been adding their own commentary to decisions in order to condemn Trump, his supporters, and his policies.I previously wrote about this pattern of extrajudicial commentary.District Court JudgeTanya Chutkan, an Obama appointee who previously presided over Trumps election interference case, was criticized for failing to recuse herself from that case after she made highly controversial statements about Trump from the bench. Chutkan lashed out at "a blind loyalty to one person who, by the way, remains free to this day." That "one person" was still under investigation at the time, and when Trump was charged, Chutkan refused to let the case go.Later, Chutkan again added her own commentary when asked to dismiss a case due to Trump pardoning January 6 defendants. She acknowledged that she could not block the pardons, but proclaimedthat the pardons could not change the "tragic truth" and "cannot whitewash the blood, feces and terror that the mob left in its wake. But displeasure and sympathy are not enough in a court of law."For Jackson, her opinions have at times left her isolated on the Court. Weeks ago, Jackson and Sotomayor were alone in dissent over the defiance of a district court judge of the Court's decision on universal injunctions. To her credit, Justice Elena Kagan (who voted with Sotomayor and Jackson in dissent in the earlier case) voted with her conservative colleagues in rebuking Judge Brian Murphy in Boston.Kagan joined in the reversal of Murphy's conflicting order and wrote the neworder "clarifies only one thing: Other litigants must follow the rules, but the administration has the Supreme Court on speed dial."This week, Jackson lost even Sotomayor and stood alone in her dissent in support of an injunction over plans to downsize the government. For years, justices have yielded to the temptations of public speaking before supportive groups. I have long been a critic of what I called the era of "celebrity justices," where members seem to maintain political constituencies at public events.Such speeches not only undermine the integrity of the Court by discussing matters that may come before it, but they can create a desire to maintain the adoration of supporters. The greatest danger is that justices will consciously or subconsciously pander to their bases with soundbites and inflammatory rhetoric.Judicial advocacy from the bench has been a concern since the founding. Article III can have a corrosive impact on certain jurists who come to view themselves as anointed rather than appointed. Most judges and justices are acutely aware of that danger and struggle to confine their rulings to the merits of disputes, avoiding political questions or commentary.The "opportunity to tell people how I feel" can become a slippery slope where opinions become more like judicial op-eds. The Court is not a cable show.     Republicans relentlessly use Mamdani as socialist cudgel to bash vulnerable Democrats
    Democratic socialist Zohran Mamdani's stunning Democratic Party primary victory in the nation's most populous city proved to be a gift for Republicans aiming to paint Democrats as extreme radicals.Republicans have been relentless in trying to anchor Mamdani to Democrats across the country who are running in competitive races in elections this year and in next year's midterms.One of the latest examples comes from New Hampshire, in the high-profile 2026 race to succeed retiring Democratic Sen. Jeanne Shaheen.Republican candidate and former Sen. Scott Brown went up this week with a digital ad that edits a picture of Rep. Chris Pappas, the Democratic candidate in the race, alongside photos of Mamdani and Rep. Alexandria Ocasio-Cortez, the progressive rock star who backed Mamdani.TRUMP ARGUES NYC FACES DIRE CONSEQUENCES IF COMMUNIST MAMDANI BECOMES MAYORThe caption on the ad reads "Comrade Chris."Responding, the Pappas campaign told Fox News that "Scott Brown is so desperate to make this election about anything other than the issues because he knows he embraces an agenda of higher costs and health care cuts thats deeply unpopular in New Hampshire."And Pappas campaign communications adviser Collin Gately added that "Chris is one of the most bipartisan members of Congress, and has a demonstrated record of working across the aisle to deliver results for New Hampshire."THE PLOT TO STOP MAMDANI: DEMOCRATS SCRAMBLE TO PREVENT FAR-LEFT TAKEOVER IN NYCThe National Republican Congressional Committee (NRCC) was one of the first out of the gate to capitalize on Mamdani's leftward lurch, firing off an email release minutes after his victory that claimed, "the new face of the Democrat Party just dropped, and it's straight out of a socialist nightmare."Aiming to tie House Democrats to Mamdani, NRCC spokesman Mike Marinella argued that "every vulnerable House Democrat will own him, and every Democrat running in a primary will fear him."The National Republican Senatorial Campaign (NRSC) also quickly got into the game, tying Pappas and Abdul El-Sayed - one of the contenders for the Democratic Senate nomination in battleground Michigan - to Mamdani.No surprise - the Republican attacks have even come from President Donald Trump, who, since Mamdani's victory two weeks ago, has repeatedly claimed that the 33-year-old Ugandan-born state assemblyman from the New York City borough of Queens is a "communist."Mamdani, who convincingly topped former Gov. They include a 2020 photo Mamdani posted online that shows him flipping off a statue of Christopher Columbus, stories about comments Mamdani made last December, when he said as mayor he would arrest Israeli Prime Minister Benjamin Netanyahu, and his recent comments in a cable news interview that "I have many critiques of capitalism.""The Democratic Party's trying to convince people that the tail is not wagging the dog, and they don't answer to the more extreme elements of their party," veteran Republican strategist Colin Reed told Fox News. "Now, that entire effort is undercut by a socialist winning handily in a bellwether election to determine who's going to run America's largest city.""It's a messaging nightmare that's going to unfold in real time from now until the midterms," said Reed, who is a top political adviser to Brown.MAMDANI LANDS ENDORSEMENT OF TOP CUOMO BACKERVeteran political scientist Wayne Lesperance told Fox News that "the primary challenge for Democrats regarding Mamdanis candidacy is not his policy approach.
