WWW.FOXNEWS.COMEducation Dept. launches investigation into school district accused of forcing explicit survey on studentsThe U.S. Department of Education announced on Monday that it would be launching an investigation into a Massachusetts school district after reports that students were given a survey with sexually explicit questions despite their parents opting out.In a press release, the department said that its Student Privacy Policy Office began an investigation into Burlington Public Schools after it distributed a "Youth Risk Behavior Survey" in late March. The survey featured questions about sexual experiences, alcohol use and gender identity.According to a complaint filed by the Massachusetts Liberty Legal Center, many parents chose to opt their children out because participation was voluntary. However, parents said the survey was still distributed to all students at Marshall Simonds Middle School and Burlington High School, including to those who had opted out, and that students were told they had to complete it.PARENTS WERE CONDEMNED FOR QUESTIONING DEI INITIATIVES AT SCHOOLS, NOW OFFICIALS AGREE POLICIES WENT TOO FAROne question in the 2025 survey asked students if theyve ever had sexual intercourse, describing the act in detail and providing the definitions of oral and anal sex. It also asked about the use of sex toys."Parents must be the primary decision-makers in their childrens education. The allegations that Burlington violated parents rights by administering a survey against parents wishes and particularly one that is graphic, and downright inappropriate in nature is unconscionable," U.S. Secretary of Education Linda McMahon said in a statement. "The Department will investigate this matter thoroughly and continue to resolutely defend parents rights."According to the department, the schools actions could violate the Protection of Pupil Rights Amendment (PPRA), which "allows parents to recuse their children from participating in school surveys or questionnaires that ask students certain sensitive, private information."Superintendent Eric Conti apologized at an April 1 school committee meeting for failing to honor the opt-out policy, calling it a "mistake." On April 8, the committee voted unanimously to suspend all student surveys until a new policy is adopted."We remain committed to transparency, accountability, and the well-being of all students, and we value our continued collaboration with families and the broader community," an announcement on the districts website read.MASSACHUSETTS SCHOOL UNDER FEDERAL INVESTIGATION AFTER STUDENT PLAY LIMITS AUDITIONS TO PERSONS OF COLORFox News Digital spoke to three parents at the time who voiced outrage over their children being exposed to sexually explicit questions."I felt absolutely sick to think that they were asking such explicit questions to children," Adrianne Simeone, a Burlington mother of a 13-year-old boy, told Fox News Digital in April. "Ive talked to my kids about sex. My children know about sexual reproduction, but I have not talked to them about anal sex or oral sex or sex toys. I dont think those were appropriate for minors of any age, let alone children as young as 11."In a statement to Fox News Digital this week, Burlington Public Schools reiterated that there was "no new news"regarding the announcement and acknowledged that five students were sent the survey despite opting out of the survey."The district apologized, hired an outside investigator, acknowledged faults in its opt-out procedure, put a moratoriumon all new surveys, and has begun to put corrective action in place with its legal counsel. Council passed the Comprehensive Youth Justice Amendment Act, which banned life without parole for juveniles, eliminated mandatory minimums for juveniles tried as adults, allowed for "sentence review" for individuals who have served at least 20 years for crimes committed as a minor and more.The act also encouraged counseling for youth offenders as opposed to a prison sentence and offered a victim-offender mediation program rather than prosecution for certain crimes.In 2018, the D.C. Council updated the Youth Rehabilitation Act, which increased the age of a "youth offender" from 22 to 24, made certain crimes ineligible and allowed some individuals to request their convictions be thrown out. The act gives judges sentencing discretion in certain crimes where the defendant is under 24.US ATTORNEY PIRRO SAYS ADMINISTRATION WONT TOLERATE OUT OF CONTROL CRIME IN THE NATIONS CAPITALDespite efforts to bring down juvenile crime, incidents involving minors in Washington, D.C., persisted.NBC Washington reported that the number of juveniles arrested in Washington, D.C., has increased annually since 2020, with over 2,000 arrested in 2023 and 2024 alone.Juveniles even made up a majority of robbery arrests, with 51.8% in 2024, according to police. Almost 60% of carjacking suspects in 2025 were also juveniles.Dating back to August 2023, according to the New York Post, 56% of carjacking suspects in Washington, D.C., were under 18.Former FBI special agent Jonathan Gilliam told Fox News Digital that juvenile crime was a major factor in Trump's decision to federalize the Metropolitan Police Department, and said the light punishments only lead to repeat offenders."The same criminals are doing things over and over again and not getting punished for it, and that's what occurs when you have juveniles," Gilliam said. "All of this has to do with politics, but the reality is, at 15 years old, if somebody is making decisions on murder, that individual is doing adult crime, and they should be charged as such."Gilliam said that Washington, D.C., became more dangerous when politicians began "chopping" away at law enforcement.DC US ATTORNEY SAYS ENOUGH IS ENOUGH AS YOUTH CRIME PUTS SPOTLIGHT ON NATIONS CAPITAL"In the way that things began to get more dangerous and a lot of those things have to do with city councils and mayors slowly at first chopping away at law enforcement," Gilliam said.In some cases, after the Comprehensive Youth Justice Amendment Act became law in Washington, D.C., some criminal sentences have raised eyebrows.19-year-old Javarry Peaks shot a stranger inside a Washington Metropolitan Area Transit Authority bus on March 8, according to the Department of Justice. Prosecutors said Peaks boarded the bus at 9:30 p.m. and began talking to someone. Prosecutors said the victim was shot in the chest after he attempted to push Peaks off.Under the Youth Rehabilitation Act, D.C. Superior Court Judge Rainey Brandt suspended Peaks' four-year prison sentence followed by three years of supervised release, and only gave Peaks probation, according to WUSA9.U.S. Attorney for the District of Columbia Jeanine Pirro wasn't pleased with the judge's decision."This violent teen boarded public transportation with an illegal firearm and shot the victim in the chest," Pirro said. "His actions are reprehensible and dangerous, and it is only by the grace of God that the victim did not die and that others were not harmed that day.""D.C. will not be safe until judges hold violent offenders accountable by putting them in jail.
