WWW.FOXNEWS.COMPentagon speech crackdown on anti-Kirk posts echoes 2021 drive against right-wing extremismThose who dismiss celebrations of Charlie Kirks murder as harmless free speech may have forgotten that the Pentagons crackdown on extremism began in 2021 after the Jan. 6 Capitol riot.That year, the then-Defense Department, which was renamed the Department of War under the Trump administration, rewrote its standards for "extremism" within the ranks, making clear that even liking or retweeting certain content could prompt discipline. At the time, the initiative largely targeted right-wing extremism.Now, Pentagon leaders are once again scouring social media this time suspending officers who appear to cheer on the political assassination that has shaken the country over the past six days."It is unacceptable for military personnel and Department of War civilians to celebrate or mock the assassination of a fellow American. The Department of War has zero tolerance for it," Sean Parnell, chief Pentagon spokesman and senior advisor, declared in a post on X."Hunting down and prosecuting service members for their individual political beliefs is dangerous and un-American," Rep. Jason Crow, D-Colo., a former Army Ranger, warned on X in response to the directive.In 2021, after several service members were implicated in the Capitol riot, then-Defense Secretary Lloyd Austin ordered a department-wide "stand-down" and created a Countering Extremist Activity Working Group. Its recommendations led to changes in the War Departments code (DoDI 1325.06), which formally defined "extremist activities," such as advocating violence, terrorism or the overthrow of the U.S. government.PENTAGON CALLS CHARLIE KIRK POSTS DOMESTIC TERRORISM; DEM WARNS DISCIPLINE IS UN-AMERICANFor the first time, the Pentagon explicitly stated that social media activity including likes or shares could be treated as an endorsement of extremism and grounds for discipline. The code also standardized recruit screening questions on extremist ties and issued new warnings to departing service members about the risks of extremist recruitment.By the end of 2021, fewer than 100 service members had been found in violation of the new standards.A June 2025 update left most of those rules intact, reaffirming that liking or sharing extremist content could be punished if it implied endorsement. But it did make one notable change: removing "gender identity" from a list of protected categories in the section banning advocacy of widespread unlawful discrimination. The 2021 version had barred discrimination based on "sex (including pregnancy), gender identity, or sexual orientation."Other agencies are taking even more aggressive steps. The State Department has announced it will revoke visas of foreigners who celebrate Kirks death, while Attorney General Pam Bondi said the Justice Department will pursue cases against those engaged in hate speech.JAY LENO CALLS CHARLIE KIRK ASSASSINATION THE 'DEATH OF FREE SPEECH'Critics warn that the wave of firings and suspensions across the Pentagon, other federal agencies and even private industry risks going beyond curbing calls for violence to punishing those who merely criticize Kirk or fail to publicly mourn him."Government employees, including military personnel, dont give up their First Amendment rights when they take the job," Aaron Terr, FIREs director of public advocacy, told Fox News Digital. "The military does have leeway to impose discipline for speech that directly undermines discipline or the chain of command, but simply expressing an opinion that others consider ugly or wrongheaded doesnt meet that standard."Another First Amendment lawyer noted that in some instances, service members may enjoy stronger speech protections than private-sector employees, who can be fired "at will.""Usually, the way a government employer gets around [free speech arguments] is to say the government has the right to protect itself from statements that cast the institution in a negative light or pose a security issue," said Jeff Lewis, a California-based attorney."So, although public employees have stronger First Amendment protections than private-sector employees, the government as an employer usually wins when free speech rights come up against its ability to hire and fire."Already, Army Col. Scott Stephens was suspended following posts purportedly belonging to him that praised the killing."The death of Charlie Kirk in Utah was tragic. However, we can take comfort in the fact that Charlie was doing what he loved best spreading hate, racism, homophobia, misogyny and transphobia on college campuses," one post read.Another Army Reserve officer was suspended over the weekend."A monster died today," read one post allegedly belonging to Maj. Out of the ashes of the Holocaust, in which nearly 50 members of his family were murdered, he coined the very word genocide to describe the Nazi attempt to annihilate the Jewish people and other targeted groups. His lifes work was to prevent such crimes, culminating in the United Nations Genocide Convention of 1948. For this, he was nominated for the Nobel Peace Prize 10 times.Today, more than six decades after his death, Lemkins name is being dragged through the mud by a Pennsylvania-based nonprofit that claims to speak in his voice but does the opposite of what he believed in. The so-called Lemkin Institute for Genocide Prevention and Human Security has misappropriated his name and weaponized his legacy not to fight genocide, but to smear Israel and its supporters.'NEVER AGAIN' REQUIRES VIGILANCE AS ANTISEMITISM SPREADS THROUGH ELITE INSTITUTIONS AND CAMPUSESOnly days after the atrocities of Oct. 7, 2023, when Hamas terrorists butchered, raped, and kidnapped innocent civilians in Israel, the Lemkin Institute labeled Israels defensive response as genocide. Just five days later, it went so far as to call on the International Criminal Court to indict Israels prime minister for "the crime of genocide." The organizations posts have been viewed millions of times, magnifying this grotesque distortion across the globe.Let us pause on the perversity here. The word genocide was created by a Jew, for the world to understand what happened to the Jewish people under Nazi Germany. Now, an institution cloaking itself in his name uses it to demonize the Jewish state itself. That is not advocacy. It is desecration.Worse, the Institute has repeatedly defended or excused terrorist organizations. It condemned Israel for targeting Hamas leaders like Ismail Haniyeh, even portraying Hamas as part of a legitimate "response to European imperialism." It has painted Hezbollah another group sworn to Israels destruction as a victim of "terrorism" at Israels hands. And in its rhetoric, the United States is no better. The Institute has accused America of complicity in "genocide" merely for standing by its ally.This isnt genocide prevention. Joseph Lemkin, a surviving relative and attorney, has joined with the European Jewish Association to demand action from Pennsylvania authorities. Their lawyers have filed a complaint to Gov. Josh Shapiro and the Bureau of Corporations and Charitable Organizations, arguing that the Lemkin Institute is violating both state and federal law.The list of potential violations is long: unauthorized use of name and likeness, post-mortem right of publicity, identity theft, false endorsement, cybersquatting, and violations of Pennsylvanias charitable solicitation laws. The law is clear: you cannot hijack someone elses name much less one as revered as Raphael Lemkins to raise money, peddle propaganda, and mislead the public.The familys outrage is not about silencing criticism of Israel. Anyone can debate Israeli policy. But no one has the right to falsely cloak their agenda in the name of Raphael Lemkin, a man who dedicated his life to protecting Jews, not condemning them. Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), who has called GHF "an abomination" and "a death trap" that is "costing more lives than it saves."According to recent U.N. statistics, however, between July 21 and Aug. 18 there were double the number of deaths along U.N. convoy routes (576) as there were surrounding GHF sites (259).Additionally, only 14.5% of U.N. aid trucks sent into Gaza have reached their intended destinations since May due to armed looting and theft. During the same period, GHF has distributed 165 million meals to Palestinians at its secure distribution sites.GHF released a statement explaining that the COI published its report "without ever contacting" the organization, calling its statements "falsehoods that could have been easily corrected had we been asked."
