WWW.FOXNEWS.COMTrump could target Antifa with powerful RICO Act, counterterrorism expert saysAfter President Donald Trump announced that he was designating the leftist agitation group Antifa as a terrorist organization in the wake of the assassination of Charlie Kirk, one expert said the president has "powerful" tools at his disposal to dismantle the group.Michael Balboni is an attorney and former member of the New York State Assembly and Senate. During his time in office, he chaired the state senate's Homeland Security Committee, and was later appointed to the state's Domestic Terrorism Task Force under Governors Andrew Cuomo and Kathy Hochul.U.S. terrorism laws under the Immigration and Nationality Act only apply to foreign groups, so there is no federal statute for prosecuting domestic organizations as terrorists. Trump still has a tool available to combat Antifa, though, in the form of the Racketeer Influenced and Corrupt Organizations Act (RICO).HOUSE FREEDOM CAUCUS CHAIR, OTHER REPUBLICANS BACK TRUMP IN DESIGNATING ANTIFA A TERROR ORGANIZATION"RICO doesn't relate only to one specific act and one specific time," Balboni told Fox News Digital. "It could be an analysis of an ongoing criminal enterprise."He explained that for a defendant to be convicted under the RICO Act, there must be an existence of an enterprise, a pattern of racketeering activity within the past decade, a demonstration that the threat of continued criminal behavior exists and that the defendant must be associated with or employed by the enterprise."Perhaps you could even use RICO or other statutes to try to do an enterprise-wide roll-up of these individuals, whether or not you need to designate them as a terrorist group," Balboni said, adding that it's a "very powerful tool."But, he warned, the Trump administration will have to be very careful not to impede upon the First Amendment rights of Americans who are peacefully protesting, versus far-left groups who commit violent acts like many across the country did in the wake of George Floyd's 2020 death or the anti-ICE riots in Los Angeles earlier this year.TRUMP TO DESIGNATE ANTIFA A 'MAJOR TERRORIST ORGANIZATION'"It's a very fine line, but once somebody steps over the line and lights a building on fire, most people would assume, yes, that's a criminal act, that's arson, and regardless of your beef, of your argument, you're going to go to jail," said Balboni.Citing Trump's past record, Balboni thinks that the president has a high probability of success in using current laws to make a significant impact to combat Antifa's operations."So this is what President Trump has been able to do successfully," he said. The former NCAA swimmer, who rose to prominence in 2022 for speaking out about her experience competing against transgender swimmer Lia Thomas, said that a mob of protesters stormed the event, disrupted her with aggressive chanting, flickered the lights and surrounded her."I [was] so disoriented, you have men and dresses and women with beards. I'm confused, fists are flying in my face," Gaines, who is a host of her own Outkick show, told Fox News Digital.The conservative activist said that a plainclothes police officer pulled her out of the scrum and through a back exit into a hallway, where even more protesters were waiting. She said she took refuge in a nearby classroom for hours into the night as demonstrators gathered outside.FEARLESS TOUR TAKES CHARLIE KIRKS FREE SPEECH MISSION TO COLLEGES NATIONWIDEGaines told Fox News Digital that protesters demanded money if she wanted "to see my family again," and the campus cops failed to disperse the crowd, allegedly saying they couldnt be seen as antagonistic to the transgender community. I broke down in tears and I looked at the officer and I said, I just want to go home, and he looked at me and he said, that's a bit selfish, don't you think we want to home too?" Gaines told Fox News Digital.The 12-time All-American swimmer said she was ultimately freed when the San Francisco Police Department (SFPD) arrived. She emphasized that she was pro-law enforcement but had criticisms of the way campus police handled the incident. Gaines later returned to the campus with Kirk in May as part of his American Comeback Tour. She said she was dismayed to see that many of the same campus police who had worked at her previous event had returned to be her security.YEARS OF CAMPUS ATTACKS ON CONSERVATIVE ACTIVISTS RESURFACE AFTER CHARLIE KIRKS MURDER"There was no accountability, there was nothing done to the students, to the university administrators who enabled this, there was nothing done to the campus police who facilitated an environment where the students were able to get away with this. They were still there working I was very shocked by that, but now I realize I really shouldn't have been," Gaines told Fox News Digital.Security at college campuses for conservative speakers has become an increasing concern in the aftermath of Kirks assassination. The Turning Point USA co-founder was gunned down Sept. 10 during an event at Utah Valley University after he took a question about transgender mass murderers. His alleged shooter, Tyler Robinson, had a transgender partner. Robinson was turned into law enforcement by his father after the attack. She added that she has ten college stops scheduled for the fall, some of which were supposed to be with Kirk, but given that she has a baby on the way, she is now extremely worried about continuing to appear at American universities."I hate to admit it, but it has me afraid, especially as I'm about to enter into this new stage of life where I'm due with a baby girl any day now I have to consider my family," Gaines said.Ultimately, she was feeling a profound sense of mourning for her lost mentor and friend. Gaines told Fox News Digital that Kirk gave her her start as a speaker and that she would often lean on him for advice."He had this ability to connect with people that very, very few people have. It is such a rare, underrated trait to be able to make people feel seen. It doesn't matter if it was the president himself or an 18-year-old freshman in college. Make truckers learn English againThe tragic 2017 death of 18-year-old Connor Dzion in northern Florida shows us the catastrophic consequences of weak enforcement of commonsense road safety measures. Connor was killed by a distracted truck driver who could not read English and ignored critical warning signs as he barreled down the highway. This was a preventable tragedy, not a simple mistake.American lives should not be considered collateral damage for failed social justice initiatives or the desires of shifty trucking companies that seek to undercut the wages of domestic truck drivers. Congress must act decisively.That is why Rep. Dave Taylor, R-Ohio, and I introduced Connors Law to codify the long-standing, commonsense English language proficiency (ELP) requirement for commercial motor vehicle drivers. This bill would ensure CDL holders who cannot read or speak English are placed out of service.These are not new expectations or requirements. Existing federal regulations have in fact long stipulated that CDL drivers must "read and speak the English language sufficiently to converse with the general public, to understand highway traffic signs and signals in the English language, to respond to official inquiries, and to make entries on reports and records."FLORIDATRAGEDYSHOWSWHYTRUMPSTRUCKING LICENSECRACKDOWNISNEEDEDIn 2016, however, the Federal Motor Carrier Safety Administration (FMCSA), at the direction of the Obama administration, quietly stripped English-proficiency violations from its out-of-service criteria, effectively gutting enforcement of that commonsense rule.Having learned of this risk early in my tenure as Wyomings congresswoman, I began calling for a return to enforcement. On April 10, 2025, I sent a letter to U.S. Secretary of Transportation Sean Duffy identifying this issue and noting that "with the number of accidents involving CMVs on the rise, it is critical that we take steps to uncover and reevaluate these sorts of concealed policies."Being true to their pledge of responsiveness and accountability, Secretary Duffy immediately reiterated that this administration would again enforce the ELP requirements. Under President Donald Trump, the FMCSA then issued new guidance to inspectors to assess a drivers English language proficiency during roadside inspections, including driver interviews and sign-recognition assessments.THE ROAD TO PROSPERITY WILL BE PAVED BY AUTONOMOUS TRUCKINGThe driver interview requires the inspector to first initiate the inspection in English, and if the driver does not understand basic instructions, a verbal interview to evaluate their ability to converse and respond to official inquiries will be conducted. Also, the Commercial Vehicle Safety Alliance (CVSA) reinstated ELP failures as out-of-service violations.Concerningly, state enforcement remains uneven and uncertain. That is why Connors Law matters. It cements this standard into law, giving state and federal authorities the clarity and authority needed to keep our roads safe.On Aug. 21, 2025, Secretary of State Marco Rubio announced an immediate pause on all worker-visa issuance for commercial truck drivers, citing public safety concerns and the threat to American livelihoods. This restriction was adopted following the horrific crash in Florida where an undocumented driver, who failed his English assessment, was involved in a crash that killed three people as he sought to execute an illegal U-turn in the middle of a busy multi-lane highway. On Dec. 21, 2022, the life of Tyeler Harris was cut short, and Tiffany Gruetzmacher was severely injured when Saviol Saint Jean drove through an accident site and crashed into them, traveling anywhere from 45 to 60 mph. Saint Jean was not proficient in English, despite having received a CDL.While some non-English speaking drivers may understand standard road signs, such as a stop sign, they cannot understand variable-message signs (VMS) that are prevalent on our highways. In Wyoming, VMS are used across the state most especially across the full stretch of I-80 (which sees over 12,000 vehicles per day) to warn drivers of changing weather conditions, dangerous hazards and road closures.If commercial drivers cannot read English, they will miss critical VMS instructions entirely, compromising safety and increasing the likelihood of catastrophic reactions to changing road conditions.Every American deserves to be confident that when they are sharing the roadways with 18-wheelers that the person behind the wheel can read a sign, understand directions, respond to emergencies and follow the rules.
