    JONATHAN TURLEY: Democrats' rabid anti-ICE resistance in LA against Trump could backfire

    California Gov. Gavin Newsom was in his element over the weekend. After scenes of burning cars and attacks on ICE personnel, Newsom declared that this was all "an illegal act, an immoral act, an unconstitutional act." No, he was not speaking of the attacks on law enforcement or property. He was referring to President Donald Trump's call to deploy the National Guard to protect federal officers.Newsom is planning to challenge the deployment as cities like Glendale arecancelling contractsto house detainees and reaffirming that local police will not assist the federal government.Trump has the authority under Section 12406 of Title 10 of the U.S. Code to deploy the National Guard if the governor is "unable with the regular forces to execute the laws of the United States."The administration is saying that that is precisely what is unfolding in California, where mobs have attacked vehicles and trapped federal personnel.CALIFORNIA REPUBLICANS SLAM NEWSOM, BASS FOR LETTING LA BURN WITH RIOTS AMID TRUMP IMMIGRATION BLITZMost critics are challenging the deployment on policy grounds, arguing that it is an unnecessary escalation. However, even critics like Berkeley Law Dean Erwin haveadmittedthat "Unfortunately, President Trump likely has the legal authority to do this."There is a fair debate over whether this is needed at this time, but the president is allowed to reach a different conclusion. Trump wants the violence to end now as opposed to escalating as it did in the Rodney King riots or the later riots after George Floyd's death, causing billions in property damage and many deaths.Courts will be asked to halt the order because it did not technically go through Newsom to formally call out the National Guard.ANTI-ICE PROTESTERS IN LOS ANGELES SPIT ON AND BURN AMERICAN FLAGSection 12406grants Trump the authority to call out the Guard and employs a mandatory term for governors, who "shall" issue the president's order. In thememo, Trump also instructed federal officials "to coordinate with the Governors of the States and the National Guard Bureau."Newsom is clearly refusing to issue the orders or coordinate the deployment.Even if such challenges are successful, Trump can clearly flood the zone with federal authority. Indeed, the obstruction could escalate the matter further, prompting Trump to consider using the Insurrection Act, which would allow troops to participate directly in civilian law enforcement.In 1958, President Eisenhower used the Insurrection Act to deploy troops to Arkansas to enforce the Supreme Courts orders ending racial segregation in schools.NY TIMES SAYS 'REAL EMERGENCY' IS TRUMP SENDING TROOPS TO LOS ANGELESThe Trump administration has already claimed that these riots "constitute a form of rebellion against the authority of the government of the United States." In support of such a claim, the administration could cite many of the Democratic leaders now denouncing the claim.After January 6th, liberal politicians and professors insisted that the riot was an "insurrection" and claimed that Trump and dozens of Republicans could beremoved from ballotsunder the 14th Amendment.Liberal professorsinsistedthat Trump's use of the word "fight" on January 6th and his questioning of the results of an election did qualify as an insurrection. They argued that you merely need to show "an assemblage of people" who are "resisting the law" and "using force or intimidation" for "a public purpose." The involvement of inciteful language from politicians only reinforced these claims. Sound familiar?Democrats are using this order to deflect from their own escalation of the tensions over the past several months. From Minnesota Gov. Tim Walz calling ICE officers "Gestapo" to others calling them "fascists" and "Nazis," Democratic leaders have been ignoring objections that they are fueling the violent and criminal responses. A Los Angeles City Council member, Eunisses Hernandez, reportedly urged anti-law enforcement protesters to "escalate" their tactics against ICE officers:"They know how quickly we mobilize, thats why theyre changing tactics. Because community defense works and our resistance has slowed them down before and if theyre escalating their tactics, then so are we. When they show up, we gotta show up even stronger."So, L.A. officials are maintaining the sanctuary status of the city, barring the cooperation of local police, and calling on citizens to escalate their resistance after a weekend of violent attacks.     Several Democratic National Committee officers are accusing DNC vice chair David Hogg of leaking an audio recording exposing infighting, as the 25-year-old progressive reformer faces possible ouster.Politico first obtained about two minutes of audio from a May 15 Zoom call in which Democratic National Committee Chair Ken Martin is heard accusing Hogg of impacting his ability to lead.Hogg, 25, was elected vice chair in February but is currently at risk of losing that role after stirring tensions with party leadership. A survivor of the 2018 Marjory Stoneman Douglas High School shooting in Parkland, Florida, Hogg has been vocal about how his group, Leaders We Deserve, is planning to spend $20 million to support progressive and primarily younger candidates challenging incumbent Democrats in safe districts during the next election."It has plenty of warts, and were all trying to change those, for sure, but the longer we continue this fight, the harder it is for us to actually do what we all want to do, which is make a difference in this country again," Martin said in the recording, as the party is trying to regroup following Democrats' 2024 election defeat.DAVID HOGG CLASHES WITH AN IRATE JAMES CARVILLE OVER DEMOCRATIC PRIMARY PLAN, CALLS ON HIM TO 'WIN ELECTIONS'About 10 people were on the call, including Hogg, other DNC officers and staff, according to Politico."I deeply respect you, David. Im used to getting beat up on.""But you know, this is, this is really, everything you know from this election, this credentials report, how Malcoms been treated in this to you know, the fact the election itself, how Shasti and Jeanna were treated in this," Martin said.     Abrego Garcia return to US prompts new questions for other immigrants deported by Trump

    The Trump administration on Friday announced it had returned Kilmar Abrego Garcia a Salvadoran migrant and alleged MS-13 member to the U.S., months after he was deported to El Salvador in what officials later acknowledged was an administrative error.It is unclear whether Abrego Garcias return signals a shift in policy or is merely a one-off. The administration paired the announcement with news of a new federal indictment charging him with crimes related to transporting undocumented immigrants in the U.S.Still, the case has sparked fresh questions about the administrations willingness to comply with other court orders requiring the return of deported migrants whether individuals or entire classes or mandating that certain individuals remain in U.S. custody long enough to challenge their removals to so-called "third countries."It also undercut the Trump administration's assertion earlier this year that it is powerless to order El Salvador to return a prisoner or facilitate the return of migrants sent to El Salvador something judges have attempted somewhat unsuccessfully to square in various court proceedings this year. Here is what to know about those cases so far.100 DAYS OF INJUNCTIONS, TRIALS AND 'TEFLON DON': TRUMP SECOND TERM MEETS ITS BIGGEST TESTS IN COURTDaniel Lozano-Camargo, previously referred to in court documents as "Cristian," is a 20-year-old Venezuelan immigrant deported in March under the Alien Enemies Act, a 1798 wartime law invoked by Trump to quickly remove hundreds of immigrants and send them to El Salvador to be detained in the countrys maximum-security CECOT prison.U.S. District Judge Stephanie Gallagherruled in April that his deportation violated a settlement agreement that the Department of Homeland Security (DHS) stuck last year with a group of young asylum seekers, including Lozano-Camargo, who had entered the country as an unaccompanied child and later sought asylum.Under that agreement, DHS agreed not to deport the immigrants until their asylum cases were fully adjudicated in court, which she said had not happened in Lozano-Camargos case prior to his removal.Gallagher, a Trump appointee, ruled that his deportation was a breach of contract. In ordering his return to the U.S., she stressed that her ruling had nothing to do with the strength of his asylum request in question a nod to the two apparent low-level drug offenses he had racked up prior to his removal but simply his ability to have his asylum request adjudicated in court under the agreement with DHS.The U.S. Court of Appeals for the Fourth Circuitupheld that decision late last month, clearing the way for Gallagher to set a formal timeline for the government to comply with facilitating the return. DHS officials told the court last week in a status update that Lozano-Camargo remains held at CECOT.TRUMP ADMINISTRATION ASKS SUPREME COURT TO REVIEW EL SALVADOR DEPORTATION FLIGHT CASEThe Trump administration returned a mistakenly deported Guatemalan native to U.S. soil last week, marking thefirst known instance of the Trump administration complying with a judges orders to return an individual removed from the U.S. based on erroneous information.The immigrant, referred to in court documents only as "O.C.G.," was deported to Mexico in March without due process and despite his stated fears of persecution in the country, according to U.S. District Judge Brian Murphy, who ordered his return.Murphy noted that O.C.G. had previously been held for ransom andraped in Mexico but was not afforded the chance to assert those fears prior to his removal a right afforded to him by U.S. and international law.ICE officials told the court earlier this month that they were working to secure his return. Last week, attorneys for O.C.G. told Fox News he had been returned to the U.S. on Wednesday via commercial flight.Unlike the individuals deported to CECOT, however, O.C.G. had not been detained in Mexico after he was deported, which could have eased some of the hurdles for the administration in returning him.Murphy ordered the Trump administration to keep in U.S. custody a group of six immigrants who were deported to South Sudan without due process or notice until they have the opportunity to conduct so-called "reasonable fear interviews," or a chance to explain to U.S. officials any fear of persecution or torture, should they be released into South Sudanese custody.Currently, all six individuals remain detained at a U.S. military base in Djibouti the only U.S. military base currently operational in all of Africa and where ICE officials tasked with keeping them in custody cited recent health risks, including from malaria exposure, searing heat, nearby burn pits as well as the "imminent danger" of rocket attacks from terrorist groups in Yemen.In response, Murphy reiterated earlier this month that the individuals need not remain in South Sudan and that the U.S. is free to move them to another location, including back to the U.S., to more safely carry out these proceedings. It is unclear whether the government has plans to relocate the group.WHO IS JAMES BOASBERG, THE US JUDGE AT THE CENTER OF TRUMP'S DEPORTATION EFFORTS?U.S. District Judge James Boasberg last week ordered the Trump administration to provide all non-citizens deported from the U.S. to a maximum-security prison in El Salvador to be afforded the opportunity to seek habeas relief in court and challenge their alleged gang status the latest in a heated fight centered on Trump's use of the 1798 Alien Enemies Act to deport certain migrants.Boasberg reiterated in the 69-page ruling that due process includes providing migrants deported to CECOT prior notice of removal, as well as so-called habeas protections, or the right to challenge their removals in court. He gave the Trump administration until Wednesday to submit to the court plans for how it will go about providing the habeas relief to plaintiffs held at CECOT."Defendants plainly deprived these individuals of their right to seek habeas relief before their summary removal from the United States a right that need not itself be vindicated through a habeas petition," Boasberg said in his order.The order is almost certain to spark fierce backlash from the Trump administration, which has previously railed against Boasberg's earlier rulings and the temporary restraining order handed down in March. Boasberg later found probable cause to hold the administration in contempt of court, citing the government's "willful disregard" for his March 15 emergency order, which ordered the administration to halt its deportation under the Alien Enemies Act, and immediately return all planes to the U.S., which did not happen.

He said the law enforcement agency was executing warrants on specific criminal activity and noted that the news ignored that, choosing to characterize the actions as wide-ranging immigration raids that were "separating families.""The facts never got out. Even though we put the facts out, the media didnt cover it.     Boston judge accused of helping illegal alien evade ICE agent, escape courthouse faces hearing

    A Boston judge accused of helping an illegal alien evade U.S. Immigration and Customs Enforcement and escape out of the courthouse in 2018 is facing a misconduct hearing on Monday.The judge, Judge Shelley M. Richmond Joseph, is currently facing a civil misconduct charge from a 2018 incident in which she allegedly helped Jose Medina-Perez, a Dominican national who had been deported twice, leave Newton District Court undetected. Medina-Perez, who had been prohibited from re-entering the United States until 2027, had appeared in court on drug possession charges and a fugitive warrant from Pennsylvania and an ICE agent was waiting to take him into custody.Joseph is appearing before the Suffolk Superior Court in Bostonon Monday and the hearing is ongoing. Presiding Judge Denis McInerneysaid that he will issue a report after the hearing concludes of his findings and recommendations.US DROPS CHARGES AGAINST JUDGE ACCUSED OF HELPING ILLEGAL IMMIGRANT AVOID ICE CAPTUREAt the start of the hearing, Joseph's counsel emphasized that her client had not been convicted of any crime."If you were to walk down the street and take a survey of the people you meet, 100% of them would tell you Judge Joseph let an illegal immigrant out the back door of the district court," her counsel said in an opening statement. "Fifty percent of them would tell you that she's a criminal, and she should go to jail. Fifty percent would tell you she's a folk hero for what she gave. But 100% would tell you she did it. It has become such a part of local lore in Boston that the media, for the most part, have dropped the niceties of alleged or charged, and they report and make references to this incident as if a dozen people had seen Judge Joseph get off the bench, escorted the defendant to the door, gave him a hug and wished him Godspeed."Medina-Perez's attorney, David Jellinek, has also taken the stand for cross-examination. He struck an immunity deal with federal authorities to testify against Joseph.In 2019, the Justice Department indicted Joseph and former trial court officer Wesley MacGregor on obstructive of justice charges. Both pleaded not guilty.MASSACHUSETTS JUDGE WHO HELPED ILLEGAL IMMIGRANT ESCAPE ICE ARREST INDICTED, FEDERAL AUTHORITIES SAYFederal prosecutors alleged Joseph instructed a court clerk to tell the ICE agent present to wait in the lobby, claiming that if the defendant was released, he would come out through the courtroom door into the lobby. Later, Joseph allegedly ordered the courtroom clerk to "go off the record for a moment" and the courtroom audio recorder was turned off for 52 seconds.Once the audio record was back on, Joseph said she would release the defendant. Federal prosecutors said Medina-Perez's defense attorney had asked to speak with the defendant downstairs and Joseph responded, "Thats fine. Of course." When reminded by the clerk that an ICE Officer was in the courthouse, Joseph allegedly stated, "Thats fine. Im not gonna allow them to come in here. But hes been released on this," according to court documents.Prosecutors said MacGregor allegedly escorted the defendant, his attorney and an interpreter downstairs to the lockup and used his security access card to open the rear sally-port exit and release the defendant.The Justice Department agreed to drop the charges against Joseph in September 2022 after she referred herself to the Massachusetts Commission on Judicial Conduct (CJC) and admitted to certain facts related to the case.The Massachusetts CJC filed formal charges accusing Joseph of "willful judicial misconduct" and conduct "prejudicial to the administration of justice."
