The more aggressive elements of President Trumps immigration agenda have run into resistance from federal district judges. These courts question the administrations expedited deportations of illegal Venezuelan migrants with minimal, or no, due process. But a more fundamental constitutional question lies beneath the struggle over immigration. Federal judges that block the deportations risk interference with the executive branchs constitutional authority over foreign relations and national security. At the same time, if the White House presses his claims of unilateral power too far, it jeopardizes the deference that the judiciary has long offered presidents in their management of national security.The president and the judiciary are coming to a head because of decisions by two separate federal district judges last week. On May 1, Judge Fernando Rodriguez of Texas held that Trump could not claim power under the 1798 Alien Enemies Act to remove members of the Venezuelan Tren de Aragua gang (TdA) to El Salvador. On May 6, Judge Charlotte Sweeney in Colorado agreed and also enjoined the executive branch from any further deportation of Venezuelans without a hearing before a judge. While only temporary orders, no federal courts have ever before overruled the decision of a president or congress that the United States has suffered an attack or invasion.Part of the blame for this executive-judicial conflict also rests with the Trump administrations unprecedented use of the Alien Enemies Act. The act authorizes the president to detain and expel aliens of "a hostile nation or government" with which the United States is in a "declared war" or by which it has suffered an "invasion or predatory incursion." Trump claimed that TdA is "closely aligned with, and indeed has infiltrated," the Venezuelan government, so as to meet the Acts requirement of an invasion by a "hostile nation or government." The White House made the extraordinary claim that a gang has risen to the level of a foreign government that is conducting an invasion or predatory incursion into the United States.Regardless of the challenge of showing this to be true factually, district judges have made the mistake of concluding this is a question for the courts to resolve. On some important questions, the Constitution reserves judgment to the elected branches of government alone. As Chief Justice John Marshall conceded in Marbury v. Madison, which first announced the power of judicial review, "the President is invested with certain important political powers, in the exercise of which he is to use his own discretion." For his decisions, "he is accountable only to his country in his political character, and to his own conscience." His decision cannot be questioned in court because "the subjects are political." In the Prize Cases, for example, the Supreme Court would not second-guess President Abraham Lincolns awesome decision to wage war to stop secession. "Whether the President in fulfilling his duties as Commander in Chief" was justified in launching military operations against the South, the Court declared, was "to be decided by him." The Court could declare that it must reserve to the President the decisions on the force to be used to "the political department of the Government to which this power was entrusted." Following this precedent, federal judge rejected lawsuits seeking a halt to the wars in Korea, Vietnam, Kuwait, Afghanistan, or Iraq.But in the Texas and Colorado cases, federal judges have overturned the judiciarys deference on war. They rejected President Trumps claim that Venezuela had launched an invasion of the United States using TdA as an arm of its military. The federal appeals courts, and ultimately the Supreme Court, must review these decisions as soon as possible. They must recognize that trial judges lack the competence to review the sensitive information and judgments necessary to make the more dire national security decisions. Courts excel at resolving cases or controversies with formal rules of pleading, evidence, and deliberation. They are ill-equipped to judge the probabilities and risks that govern the world of national security.

A common ingredient in some foods and drinks has been linked to an increased risk of blood cancers.Taurine a non-essential amino acid that also occurs naturally in the bone marrow, brain, heart and muscles was found to promote the growth of leukemia cells, according to a study by Wilmot Cancer Institute investigators at the University of Rochester in New York.The compound is also found in meats, fish and eggs, as well as some energy drinks and protein powders.BLOOD CANCER AWARENESS: COMMON TYPES, SIGNS AND TREATMENT OPTIONS"The key takeaway from this study is that taurine can be used by leukemia cells to promote cancer progression," Jeevisha Bajaj, PhD, an assistant professor in the Department of Biomedical Genetics and a member of Wilmots Cancer Microenvironment research program, told Fox News Digital."Developing new methods to block the cancer cells ability to take in taurine may improve outcomes for leukemia patients."The scientists made the discovery by happenstance as they were investigating the bone marrow with an eye toward improving treatments for blood cancer, according to a press release from the university."Our finding that taurine can be produced by the bone marrow microenvironment was completely unexpected and therefore surprising," Bajaj said. "No one had shown this before, and it added critical information to studies of the bone marrow microenvironment, where blood cancers arise and expand."KIDS WHO CONSUME ENERGY DRINKS ARE MORE PRONE TO MENTAL HEALTH DISORDERS, STUDY FINDSThe taurine triggers cancer growth in leukemia cells by promoting a process called glycolysis, which breaks down glucose to produce energy.In particular, taurine fuels certain types of cancer that emerge from blood stem cells in the bone marrow, including acute myeloid leukemia (AML), chronic myeloid leukemia (CML) and myelodysplastic syndromes (MDS), the release stated.The findings were published in the journal Nature."We are very excited about these studies because they demonstrate that targeting uptake by myeloid leukemia cells may be a possible new avenue for treatment of these aggressive diseases," said Bajaj.TERMINAL COLON CANCER PATIENT SAVED BY BREAKTHROUGH TREATMENT"Our work suggests that developing and testing effective drugs that can impede leukemia cells from using taurine could lead to new treatment approaches for these deadly cancers."The study did have some limitations, according to the researchers."While we can find that taurine levels are high in the bone marrow of mice with leukemia compared to healthy mice, we do not have any evidence on taurine levels in humans with acute myeloid leukemia," Bajah noted. "This is something we hope to study in the future."Looking ahead, the researchers also plan to study how myelodysplastic syndromes lead to acute leukemia.Based on the findings, the scientists recommend that patients with leukemia speak with their healthcare providers before adding any new supplements or foods rich in taurine to their diet."Since taurine is a common ingredient in energy drinks and is often provided as a supplement to mitigate the side effects of chemotherapy, our work suggests that it may be of interest to carefully consider the benefits of supplemental taurine in leukemia patients," the researchers concluded in the paper.Dr. Marc Siegel, clinical professor of medicine at NYU Langone Health and Fox News senior medical analyst, was not involved in the study but commented on the findings."The study from the University of Rochester determined that leukemia cells in the bone marrow rely on the amino acid taurine that they dont make themselves," he told Fox News Digital. QUEENS, N.Y. A well-known local brothel near two schools in Rep. Alexandria Ocasio-Cortez's red-light district has been shut down by the NYPD after months of advocacy by local leaders who say the progressive lawmaker did nothing to help them close it.Nicknamed the "bodega brothel" by locals, the establishment was operating on the second floor of a local bodega just off the Roosevelt Avenue strip in Queens, where prostitutes are known for openly soliciting sex on sidewalks, local Democratic district leader Hiram Monserrate told Fox News Digital.Video from inside the brothel reveals five cramped, makeshift rooms divided by wooden panels and shower curtains, each just large enough to hold a bed.AOC'S 'RED LIGHT' DISTRICT OVERRUN WITH PROSTITUTES AS LOCALS CALL OUT MIA 'SQUAD' MEMBERThe bodega is located across the street from two public schools, and students have been forced to walk past the sex workers outside the brothel on their way to and from class for months. An hour before Ocasio-Cortezs town hall earlier this month, Fox News Digital observed children walking by with their parents as three women stood outside.On Monday, the NYPD removed the beds from the brothel and padlocked its makeshift wooden door.Monserrate, who led the campaign to shutter the location, stood outside and praised the police for acting."The shutting down of the bodega brothel was long overdue, but it finally got done," said Monserrate, who also toured the brothel and described the sleazy state of the quarters."This place is clearly unsightly and unsanitary, and, quite frankly, disgusting," said Monserrate, a former Democratic state senator and council member who said he organized four separate rallies to close down the brothel.LEADERS IN AOC'S 'RED LIGHT' DISTRICT CALL ON KASH PATEL TO CRUSH 'WORSENING' GANG CRIME AND PROSTITUTIONMonserrate said he and local groups have called on Ocasio-Cortez and other elected officials to advocate for the shuttering of the brothels, but few have helped."AOC did not play a role at all," said Monserrate, who was chased out of a local square in October because he opposed protesters advocating for prostitution to be allowed in the neighborhood.Ramses Fras, a local Republican city council candidate, also said Ocasio-Cortez never attended a demonstration."It took the people to come together and rally against this bodega brothel," Frias said. Ocasio-Cortezs office told Fox News Digital it is not commenting on the closure.Monserrate said the area is plagued by prostitutes, many working at the behest of migrant gangs like the 18th Street Gangand Tren de Aragua. He has called on the FBI to intervene along Roosevelt Avenue, citing drug trafficking, illegal gun sales, identity theft and violent crimes. He said he has yet to receive a response, adding his sources have identified at least 20 brothels in the area.In October, New York City Mayor Eric Adams launched a sweeping police crackdown with more than 200 police and state troopers descending on the area.The NYPD told Fox News Digital last month that the clampdown, known as Operation Restore Roosevelt, had resulted in a 37% year-to-date drop in crime in the Roosevelt Avenue zone with more than 1,800 arrests and more than 15,000 summonses.Police did not say if any arrests were made in relation to the shuttering of the location Monday.The New York City Department of Buildings said the location was issued a partial vacate order in December, but Monserrate said it had been used for illicit purposes ever since then.Monserrate said the operation Monday was helpful, but many of the problems in the neighborhood still linger."While we are grateful to the NYPD, the NYC Buildings Department and the mayor's office, we also understand that there is still much to do until we stabilize this community and make it safer and better for all," Monserrate said. "We will continue to rally, call for more brothels to be closed and shine a light on the failed policies that our community has borne the brunt of."
